Penalties for auto theft are based on the stolen vehicles’ value

Auto theft is a punishable crime

Theft, including auto theft, is a serious crime in Texas. According to state law, a person commits theft if they unlawfully appropriate (steal) someone else’s property, including vehicles. The value of the property stolen plays a crucial role in the legal process. Specifically, it determines the severity of the theft offense and the associated penalties:

  • Class A misdemeanor: If the stolen vehicle’s value is less than $2,500, the crime is punishable by up to one year in jail or a fine of up to $4,000.
  • State jail felony: If the value is between $2,500 and $30,000, the crime is punishable by 180 days to 2 years in a state jail or a fine of up to $10,000.
  • Third-degree felony: If the value is between $30,000 and $150,000, the crime is punishable by 2 to 10 years in prison or a fine of up to $10,000.
  • Second-degree felony: If the value is between $150,000 and $300,000, the crime is punishable by 2 to 20 years in prison or a fine of up to $10,000.
  • First-degree felony: If the value is $300,000 or more, the crime is punishable by 5 to 99 years in prison or a fine of up to $10,000.

Last year, Plano police helped in taking down an auto theft ring that had stolen trucks worth $2.5 million in just one month. The total value of the stolen vehicles was more than $300,000. With the value of the stolen property so high, the charges were a first-degree felony.

In addition to the theft charges, the defendants were also involved in organized criminal activity. This complicated the case and led to them facing even harsher penalties.
